Terms & Conditions:

These are the standard terms and conditions for Business Marketing, SEO-All Type Business Promotions, E-Commerce, Website Design, Mobile Application Development, Software Development and All IT related services etc apply to all contracts and all work undertaken by Mtech Solutions - MTECHS (herein referred as developer) for its clients / users / distributors.

Except otherwise noted, all of the above mentioned services included in setup package is copyrighted by developer.

Warranty by you as to ownership of intellectual property rights: You must obtain all necessary permissions and authorities in respect of the use of all copy, graphic images, registered company logos, names and trademarks, or any other material that you supply to us to include in your website or web applications. You must indemnify us and hold us harmless from any claims or legal actions related to the content of your website.

Search Engines: We do not guarantee any specific position in search engine results for your website. We perform basic search engine optimization according to current best practice.

Hacking / Spamming / Virus: We will optimize techniques and ways to strengthen website security but we are not taking any responsibility of the activities of spamming, hacking or virus attacks as they can’t be predicted.

Consequential Loss: We shall not be liable for any loss or damage which you may suffer which is in any way attributable to any delay in performance or completion of our contract, however that delay arises.

Subcontracting: We reserve the right to subcontract any services that we have agreed to perform for you as we see fit.

Non-Disclosure: We (and any subcontractors we engage) agree that we will not at any time disclose any of your confidential information to any third party.

Additional Expenses: You agree to reimburse us for any requested expenses which do not form part of our proposal including but not limited to the purchase of templates, third party software, stock photographs, fonts, and domain name registration, web hosting or comparable expenses.

Backups: You are responsible for maintaining your own backups with respect to your website and we will not be liable for restoring any client data or client websites except to the extent that such data loss arises out of a negligent act or omission by us.

Ownership of Domain Names and Web Hosting: We will supply to you account credentials for domain name registration and/or web hosting that we purchased on your behalf when you reimburse us for any expenses that we have incurred. If we use our Sever / Hosting in such case Mtech Solutions - MTECHS not liable to share credential.

Governing Law: The agreement constituted by these terms and conditions and any proposal will be construed according to and is governed by the laws of India. You and Active Growth submit to the non-exclusive jurisdiction of the courts in and of Saket, Delhi in relation to any dispute arising under these terms and conditions or in relation to any services we perform for you.

Cross Browser Compatibility: By using current versions of well supported content management systems such as “wordpress”, we endeavour to ensure that the web sites we create are compatible with all current modern web browsers such as the most recent versions of Firefox, Google Chrome and Safari. Third party extensions, where used, may not have the same level of support for all browsers. Where appropriate we will substitute alternative extensions or implement other solutions, on a best effort basis, where any incompatibilities are found.

E-Commerce: You are responsible for complying with all relevant laws relating to e-commerce, and to the full extent permitted by law will hold harmless, protect, and defend and indemnify Mtech Solutions - MTECHS and its subcontractors from any claim, penalty, tax, tariff loss or damage arising from your or your clients’ use of Internet electronic commerce.

Content: The content will be provided by client and responsibility of the content ownership. Any case of content discrepancy related to copyrighted content, copyrighted image, pornographic content, visual or written content related to any religion that may hurt religious consent is sole responsibility of Client .In such Case Client are responsible for ensuring that material Web site, (hosted by Active Growth). Complies with International and National Laws.

Disclaimer: To the full extent permitted by law, all terms, conditions, warranties, undertakings, inducements or representations whether express, implied, statutory or otherwise (other than the express provisions of these terms and conditions) relating in any way to the services we provide to you are excluded. Without limiting the above, to the extent permitted by law, any liability of Mtech Solutions - MTECHS under any term, condition, warranty or representation that by law cannot be excluded is, where permitted by law, limited at our option to the replacement, re-repair or re-supply of the services or the payment of the cost of the services that we were contracted to perform.

Active Growth only give you web based platform if you did any suspicious activity / Any Fraud through website you are only responsible for this.

2. Client / User / Distributors -License Agreement and Terms & Conditions:

Client / Users / Distributors expressly agree the use of the above service is at your sole risk. The service is provided on an "as is" and "as available" basis

Mtech Solutions - MTECHS expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Mtech Solutions - MTECHS makes no warranty the services will meet your requirements, or the services will be uninterrupted, timely, secure, or error free. Nor does Mtech Solutions - MTECHS make any warranty as to the results that may be obtained through the service or that defects in the software will be corrected.

You understand and agree any material and/ or data downloaded or otherwise obtained through the use of the service is done at your own discretion and risk and you will be solely responsible for any damage to your computer systems or loss of data that results from the download of such material and/ or data.

Mtech Solutions - MTECHS makes no warranty regarding any goods or services purchased or obtained through the service or any transactions entered into through the service. No oral or written information or advice given by Mtech Solutions - MTECHS, its officers, employees, contractors, consultants, affiliates, agents, assigns, successors or a Mtech Solutions - MTECHS authorized representative shall create a warranty.

You acknowledge that, when you click on a link to visit a linked site, a frame may appear that contains the Mtech Solutions - MTECHS logo, advertisements and/ or other content selected by activegrowth.in.

The Server Backup and Restore facility provided is a for trail run. It may not be free of any defects and developer accepts no liability on whatsoever damage caused by using above said facility.

The developer reserve full rights to withdraw any services or functionality available in from our side at any given point of time.

Mtech Solutions - MTECHS exclusively reserves the right to amend, add or remove the above terms & conditions without any prior notice to its customers.
